Still raining
A common sight on motorbikes during the wet season is the second passenger not having a rain coat. To get around this problem the second passenger can hide themselves under the back flap of the drivers rain coat. While this may stop you from getting drenched, you cannot see anything and for me personally, this would be an extremely uncomfortable feeling. If you cannot follow the flow of the traffic with your eyes you are at the complete mercy of the driver, who you hope knows what they are doing.

Does the helmet law apply if you cannot be seen by the cops?
Well, even if you could see, there isn't much you can do about a hazard anyway, I suppose. Maybe better not to know what hit ya. 6^)
